These Terms & Conditions (“Terms”) apply to the Little Hammer Books website and any other website, application, or online service that links to these Terms (collectively, the “Sites”).

Little Hammer Books is an imprint and subsidiary of Hemlock & Hammer Foundry, LLC, a Colorado company (“Hemlock & Hammer,” “we,” “us,” or “our”). We may change, modify, add, or remove portions of these Terms at any time. Please review these Terms periodically. Your continued use of the Sites after changes are posted means you accept the updated Terms.

These Terms are a legal agreement between you (“you” or “user”) and us and govern your access to and use of the Sites. By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, do not use the Sites.

Additional terms may apply to certain products, services, promotions, or events (for example, shipping, returns, ticketing rules, or contest rules). If additional terms conflict with these Terms, the additional terms control for that specific offering.

The Sites and all content on them, including text, graphics, logos, photographs, illustrations, audio, video, downloadable materials, book previews, and software (collectively, “Content”), are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print Content for personal, noncommercial use only, unless we expressly state otherwise in writing. You may not copy, reproduce, distribute, publicly display, publicly perform, modify, create derivative works from, publish, transmit, or exploit any Content without our prior written permission, except as permitted by law.

You may not remove or alter copyright, trademark, or other proprietary notices from the Sites or Content.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Sites for personal, noncommercial purposes.

This license does not permit you to:

• scrape, mine, harvest, or extract data (including through bots, crawlers, or automated tools) without our written consent
   
• interfere with the Sites’ security features or access restrictions

Unauthorized use may result in termination of your license and access.

“Hemlock & Hammer Foundry,” “Little Hammer Books,” and our logos, taglines, and related names and designs are trademarks or service marks owned by us or our licensors. You may not use our trademarks without our prior written permission.

You may link to our homepage or other public pages if your link does not suggest affiliation, sponsorship, or endorsement and does not portray us in a false, misleading, or offensive manner. We may revoke linking permission at any time.

The Sites may contain links to third-party websites or services (for example, retailers, social platforms, or ticketing services). We provide these links for convenience only. We do not control third-party sites and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

If the Sites allow purchases (for example, books, merchandise, tickets, or digital products), you agree to provide current, complete, and accurate information for the transaction.

If we use third-party payment processors, your payment information may be processed by them and subject to their terms and privacy practices. Prices, availability, and promotions may change at any time.

Shipping, returns, refunds, preorders, and fulfillment terms (if applicable) will be provided at checkout or in the relevant product policy and are incorporated by reference.

When you purchase an e-book or other digital product from us, you are purchasing a limited, non-exclusive, non-transferable, revocable license to access and use the digital product for your personal, noncommercial use only. You do not acquire ownership of the digital file or any intellectual property rights.

You may:

• download and store the e-book for personal reading
   
• access the file on your personal devices
   
• print limited portions for personal use if printing is enabled
   

You may not:

• share, distribute, sublicense, rent, or resell the e-book
   
• upload the file to file-sharing or public websites
   
• reproduce the e-book for classroom, library, or commercial distribution without written permission
   
• remove copyright notices or technical protections
   
• circumvent DRM or other security features
   

Unauthorized distribution may violate copyright law and may result in termination of your license.

Digital products are delivered electronically (for example, via download link or email).

You are responsible for:

• providing a valid email address
   
• downloading and saving your files promptly
   
• maintaining compatible devices or reading software
   

We are not responsible for compatibility issues with your specific device or reader software unless required by law.

All e-book and digital product sales are final once the product has been delivered or accessed, except where required by applicable law.

Because digital products cannot be returned, we generally do not provide refunds for:

• change of mind
   
• accidental purchase
   
• device incompatibility
   
• failure to download
   

If you experience a technical delivery issue, contact us and we will make reasonable efforts to assist.

Our collection and use of Personal Information is governed by our Privacy Policy, which is incorporated into these Terms by reference. If there is a conflict between these Terms and the Privacy Policy regarding personal data practices, the Privacy Policy controls.

If you submit content to the Sites (for example, comments, reviews, photos, or messages) (“User Submissions”), you retain ownership of your User Submissions.

By submitting User Submissions, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, host, store, display, publish, translate, modify for formatting and accessibility, distribute, and create derivative works from your User Submissions for purposes related to operating, promoting, and improving the Sites and our publishing activities.

You represent and warrant that:

• you own or have the necessary rights to submit the content
   
• your submission does not infringe intellectual property, privacy, or publicity rights
   
• you have obtained consent from identifiable individuals (and from a parent or guardian for minors where required)
   
• your submission complies with these Terms and applicable law
   

We may remove or refuse User Submissions at any time.

If you create an account on any Site:

• you must provide accurate information and keep it updated
   
• you are responsible for maintaining the confidentiality of your login credentials
   
• you are responsible for all activity under your account
   
• you must notify us promptly of unauthorized use or security breaches
   

We may suspend or terminate accounts for violations of these Terms.

You agree not to:

• use the Sites for any illegal purpose
   
• interfere with or disrupt the Sites or servers
   
• attempt to bypass security or access restrictions
   
• introduce malware or harmful code
   
• use automated tools to access or collect data without permission
   
• harass, threaten, or harm others through the Sites
   

THE SITES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Sites will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

To the maximum extent permitted by law, Hemlock & Hammer Foundry, LLC and Little Hammer Books will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of or inability to use the Sites or Content.

Our total liability for any claim arising out of or relating to the Sites will not exceed the greater of:

• the amount you paid us through the Sites in the six (6) months before the event giving rise to the claim, or
   
• $100
   

You agree to defend, indemnify, and hold harmless Hemlock & Hammer Foundry, LLC, Little Hammer Books, and their affiliates, officers, directors, employees, agents, licensors, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• your use of the Sites
   
• your violation of these Terms
   
• your User Submissions
   
• your violation of any rights of another
   

We may suspend or terminate your access to the Sites at any time, with or without notice, if we believe you violated these Terms or to protect the Sites, our users, or our rights.

Provisions that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules.

Unless otherwise required by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Sites will be brought exclusively in the state or federal courts located in Colorado.

These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and us regarding the Sites.
